Court upholds garage owner's victory over city demolition demands

The Arbitration Court of Primorsky Krai has rejected a lawsuit demanding the demolition of a garage at 27 Strelkovaya Street. The case was brought by the city administration and Urban Planning Department, who sought to declare the structure unauthorised. The court ruled in favour of the garage owner, Autopoint-VL LLC, dismissing all claims. The dispute centred on a non-residential garage measuring 186 square metres. The city administration argued it should be declared illegal and dismantled. However, the court found the garage was built on land zoned for 'permanent garages' and held a valid occupancy permit.

An on-site inspection confirmed the garage matched all approved documentation. Its area, number of floors, and construction materials aligned with official records. The court also noted no evidence that the structure failed to meet occupancy requirements.

Autopoint-VL LLC had constructed the garage under official permits. Ownership was properly registered with Rosreestr, further supporting its legitimacy. The court’s decision means the garage will remain standing. The ruling confirms its compliance with all legal and technical standards. No further action against the structure is expected.
