Omsk court fines developer for delayed apartment handovers in landmark ruling

A court in Omsk has ruled in favour of homebuyers suing a developer over delayed apartment deliveries. The case marks the first penalty enforcement since the government lifted its moratorium on such claims. Residents of the city have now begun taking legal action against multiple construction firms. The lawsuit targeted Etalon-Omsk for a 113-day delay in handing over flats. The court ordered the company to pay 428,500 rubles in penalties to the affected buyers. Additionally, the claimants received full reimbursement of their legal costs, totalling 40,000 rubles.

Homebuyers in Omsk are now pursuing similar cases against other developers. Those building the Green Island and Etalon residential complexes are among the firms facing legal challenges. The ruling sets a precedent for delayed property deliveries in the region. More lawsuits are expected as buyers seek compensation for breaches of contract. The lifted moratorium allows courts to enforce penalties once again.
